During the launching of the “Malecon Project” in Samaná, President Abinader commented that he will be submitting a second amendment to the Public-Private Partnerships (PPP) law to further reduce the deadlines, as he understands that otherwise the law will be ineffective.
Having recently taken part in PPP processes, DMK Abogados understands that “in practice PPP arrangements are more complex than hoped for, because of the studies and formalities involved in in securing them, and because of the levels of transparency that must prevail, but equally understands that we must continue learning from developed countries where this arrangement has been successful by creating conditions compatible with the need of the Executive Branch to quickly approve projects, as well as with the needs of investors advocating them.”
“The model should relieve the pressure on the State coffers, by ensuring that the competitiveness and sustainability of the offers are among the State’s priorities through its strategic Government plan, allowing the private sector to undertake construction, maintenance and operation projects that were previously disallowed. To successfully implement such arrangements, the Dominican State institutions must understand the model, fulfill their respective function, and place the common interest of the State above the individual interest of the institution.”
